If you let a Spanish property and live abroad, you're legally required to declare that income on a Modelo 210 — even if you only let it a few weeks a year, even if it ran at a loss. Spain's tax agency receives data directly from Airbnb and Booking.com, so undeclared or mis-declared income is increasingly easy to spot, and penalties run from 50% to 150% of the unpaid tax. The rules are genuinely confusing — Spain taxes the full amount the guest paid, not what landed in your bank after fees — which is exactly where people get it wrong.

Since Brexit, UK owners have been treated as non-EU and taxed at 24% on gross rental income, with no expense deductions — a worse deal than EU owners get. In July 2025 Spain's National Court ruled that non-EU owners should be able to deduct expenses too. The ruling is still subject to appeal, but owners may be able to reclaim overpaid tax for up to the last four years — and that window rolls forward, so each year an older claim drops off.
